Resumo: The present article stems from an exploratory-descriptive research that poses a question about possessory actions in collective disputes over land possession. These legal actions involve conflicts in which groups of people seek to secure their possession of a piece of land. The study examines the legal and social complexities of these disputes, highlighting issues such as land regularization, collective rights, and territorial conflicts. The work investigates how the legal system deals with such situations by analyzing case law, legal frameworks, and their impact on the communities involved. Additionally, it aims to analyze how Article 565 of the Brazilian Civil Procedure Code (CPC) operates in the reality of possessory actions. The goal is to contribute to a deeper understanding of the dynamics of these disputes and provide relevant insights for the legal and social fields. Furthermore, it seeks to discuss how these actions are treated by the Brazilian judiciary, examining whether it has been effective in safeguarding the only private right guaranteed in the constitution, the right to private property.

Essas ações legais envolvem disputas em que grupos de pessoas buscam garantir sua posse sobre uma área de terra. O estudo examina as complexidades jurídicas e sociais dessas disputas, destacando questões como a regularização fundiária, direitos coletivos e conflitos territoriais. O trabalho investiga como o sistema legal lida com tais situações, analisando jurisprudências, marcos legais e impactos nas comunidades envolvidas. Além disso, analisar de que modo o art. 565 do CPC atua na realidade que se encontra os processos em ações possessórias.
