The present work proposes itself to analyze a theme of great worldwide repercussion, stemming from important discussions that have been gaining strength throughout the years. Marijuana has been considered illegal since the mid-twentieth century and has been generating studies, creating debates and provoking controversy among experts, since this discussion surrounds relevant aspects of society such as public safety, health, punitive state, justice and social control. Facing these aspects, the legalization of marijuana arises, a measure that has been adopted in several countries, opening a plethora of possibilities to be analyzed, ranging from the social impacts generated by it to the individual health of the user. Thus, to understand such impacts, it is necessary to clarify the population about what legalization really means and discuss about the failed system of drug war, noting the implementations that other countries are using to decriminalize one of the most commonly used illegal drugs in Brazil.
