The protection of Human Rights as a legitimating discourse: the limitation of International Law in the case of Syria

Resumo: In the face of the immobility of the United Nations system, various forms of justifications to the current military interventions have been formulated, being the Human Rights discourse one of the main sources of legitimacy. It is proposed in the present work to discuss such theoretical justifications, with a view to determining whether there is a legitimation before the International Community. The role of the General Assembly of the United Nations and the possibility of its action in the conflict based on the theory of the implicit powers is also problematic. In light of the immobility of the Security Council, it is said that the General Assembly has the implicit prerogative to act. A bibliographical survey is carried out on the subject, using the hypothetical deductive method, resulting in a study on the legitimacy discourses in the case of Syria.

Propugna-se no presente trabalho discutir tais justificativas teóricas, tendo em vista determinar se existe a visada legitimação diante da Comunidade Internacional. Igualmente problematiza-se o papel da Assembleia Geral das Nações Unidas e a possibilidade de sua atuação no conflito com base na teoria dos poderes implícitos. Diante da paralisia do Conselho de Segurança, aduz-se que a Assembleia Geral possui a prerrogativa implícita de agir.
