Resumo: | The controversial surrogacy is once again the subject of scientific questions now they formulated The Declaration of Casablanca for the universal abolition of surrogacy (2023), based on the premise of its impact on the human rights of those involved, this paper examines the assumptions of said declaration and its feasibility of adoption by States to determine if said disappearance ipso facto can result in the disruption of pre-existing situations that should tend to restore the rights violated. It is assumed that, with the adoption of the declaration by the States, there would be an absolute climate of undesirable clandestinely, in consequence the states must issue the legislation to safeguard the human rights involved. The methodologies use Legal hermeneutics and epistemology, comparative law and as a technique the review of specialized literature were applied; With the above, conclusions were reached that validate the hypothesis proposed. |

El presente trabajo de investigación examina los presupuestos de dicha declaración y su factibilidad de adopción por los Estados con la finalidad de determinar si dicha desaparición ipso facto puede redundar en desdoro de las situaciones prevalecientes que deben tender a restituir los derechos violentados. Se parte de la hipótesis de que, con la adopción de la declaración por los Estados, se produciría un absoluto clima de clandestinidad nada deseable, por lo que nos inclinamos por una regulación idónea que permita salvaguardar los derechos involucrados.
