Transitional justice in Latin America and judicial protection: an analysis through some cases of the Inter-American Court of Human Rights

Resumo: The main aim of this research was the implementation and interpretation the Inter-American Court gives to Judicial Protection (article 25 of Pact of San José, Costa Rica) in cases related to Transitional Justice. The article presents the authoritarianism in Latin America; the emergence of the Inter-American System of Human Rights; the concept of Judicial Protection and the content of article 25. The study analyzed 15 Court rulings to establish a synthesis, indicating both its positive points and inconsistencies. In addition, the study analyzed the Brazilian Transitional Justice and the contribution of Inter-American Court to its strengthening. The research adopted the inductive method.

Foi apresentado o autoritarismo na América Latina; o surgimento do Sistema Interamericano de Direitos Humanos; o conceito de Justiça de Transição; e o conteúdo do art. 25. Foram analisadas 15 sentenças da Corte para estabelecer uma síntese, apontando seus pontos positivos e inconsistências; e, por fim, a Justiça de Transição brasileira e a contribuição da jurisprudência da Corte para seu fortalecimento.
