Anti-drug law in Brazil: new racial segregation?

Resumo: | The phenomenon of mass incarceration after implementation of anti-drug legislation is analyzed, examining relationship between war policies and high percentage of black and poor people present in the Brazilian prison system. It starts with a study carried out by Michelle Alexander in USA and her thesis that anti-drug policies hide a new form of racial segregation inheriting the laws known as Jim Crow. A review of scientific literature related to criminal and anti-drug policies in their relations with racial issues and with changes in pattern of police and judicial repression, systematizing public data on the Brazilian penitentiary system in comparison with the changes brought about by anti-drug legislation in Brazil. A strong relationship was revealed between legislative changes and the explosion in the number of prisoners in the country, since the anti-drug legislation allows rooted discriminatory practices to be expressed in prisons and convictions of blacks and the poor. |

Parte-se de estudo realizado por Michelle Alexander nos EUA e de sua tese de que as políticas antidrogas escondem uma nova forma de segregação racial herdeira das leis conhecidas como Jim Crow. Fez-se revisão da literatura científica relacionada às políticas criminais e antidrogas em suas relações com questões raciais e transformações do padrão de repressão policial e judicial, sistematizando dados públicos sobre o sistema penitenciário brasileiro em cotejo com as mudanças trazidas pela legislação antidrogas no Brasil.
