Resumo: This article adopts the exploratory-descriptive method conceived from bibliographic research that seeks to promote a comparative study between the competences and performance of the agencies responsible for controlling accounts in Brazil and France in relation to public procurement processes. Considering the problems that may arise from the extent of the competence of the audit courts in Brazil and from the French experience, in the end, the adoption of a more focused attitude to the evaluation of public policies and the promotion of transparency to the detriment of the exercise of a judicial function by the Brazilian audit courts is proposed, especially in relation to bidding processes, whose assessment of the legality of the acts involved could be left to internal bodies or even judicial control.
