Criminal reincidence: an analysis on its species and effects on contemporaneity

This article analyzes the theme of criminal recidivism in Brazil, seeking to understand the main aspects of recidivism rates and their effects. Through a bibliographic study and analysis of secondary data from the IPEA, the CPI of the prison system and the CNJ, the research sought to expose the interfaces of criminal recidivism in Brazil, in order to think about the prison and the declared functions of the penalty. In the midst of criminal recidivism, despite the scarcity of studies covering the topic, the study points to a great difference between the published data, productions resulting from the use in different aspects of the terminology “recidivism”. Thus, it can be seen that the prison does not fulfill the declared functions of the sentence, constituting in fact factual as a propellant of recidivism.
