International trade and Human Rights: the CISG as a protection tool

Resumo: This article intends to demonstrate the need that private international law has to cover the theme of Human Rights, specifically through the analysis of the Vienna Convention on International Sale of Goods - CISG. Therefore, a qualitative approach of bibliographic production was used, as well as the dialogical-deductive method, seeking to correlate the categories of private international law and human rights, addressing the UN Guiding Principles on Business and Human Rights as a starting point, being exemplified through the collapse of the Rana Plaza factory complex as a consequence of violations of human rights. In summary, it is concluded that the CISG can be invoked to protect such rights, through its articles 7 (2) and 35; in addition, it is also required the actuation of internationalists in the area, such as lawyers, in order to reinforce clauses in contracts that aim to protect human rights.

Portanto, foi utilizada uma abordagem qualitativa de obras bibliográficas, bem como o método dialógico-dedutivo, buscando correlacionar as categorias do direito internacional privado e dos direitos humanos, abordando os Princípios Orientadores da ONU sobre Empresas e Direitos Humanos como ponto de partida, exemplificando-se através do desabamento do complexo fabril Rana Plaza as consequências de violações de direitos inerentes à condição humana.
