Resumo: This article aims to demonstrate how technological and scientific innovation, communication and information have become determinant elements for the development of economic activities, imposing new regulatory and legal challenges. The article was elaborated based on a bibliographic review of different areas of knowledge in the Human and Social Sciences, as well as on Brazilian and on foreign legislation. In recent years, the Brazilian legal framework set forth rules about credit scoring, the uses of internet and the processing of personal data. At the same time, the State and the Judiciary have been constantly urged to solve complex issues related to new technologies, on which they often do not have the necessary knowledge and instruments to deal with effectively. In this context, proceduralization presents itself as a viable model for new technologies, due to its flexibility and learning capacity.

O presente artigo tem como objetivo demonstrar como a inovação tecnológica e científica, a comunicação e a informação se tornam elementos preponderantes para o desenvolvimento das atividades econômicas, impondo novos desafios regulatórios e jurídicos. Para tanto, o artigo foi elaborado com base em uma revisão bibliográfica de distintas áreas do conhecimento das Ciências Humanas e Sociais, bem como na legislação brasileira e estrangeira. Nos últimos anos, o ordenamento jurídico brasileiro passou a dispor sobre temas como pontuação de crédito, o uso da internet e o tratamento de dados pessoais. Ao mesmo tempo, o Estado e o Poder Judiciário têm sido constantemente instados a solucionar demandas complexas relacionadas às novas tecnologias, das quais não possuem o conhecimento e os instrumentos necessários para lidar de forma efetiva. Neste contexto, a proceduralização se apresenta como um modelo viável para as novas tecnologias, diante da flexibilização e da capacidade de aprendizagem.
