Resumo: This article aims to analyze the recognition of the precariousness of work in solidarity economy establishments, after the publication of law 12.690/2012 that regulated labor cooperatives in Brazil, based on the TRT decisions of the 4th region from July 19, 2012 to July 19, 2017. The purpose is to answer the following problem: from the condemnations/acquittals of solidarity institutions in actions that discuss the precariousness of work, solidarity economy is a model capable to overcome the organization of the current work and to promote the economic social empowerment of its workers? The initial response to the problem is negative. The research technique used was the bibliographical (articles and books) and documentary and the method used was the deductive.

The research technique used was the bibliographical (articles and books) and documentary and the method used was the deductive.Com o presente artigo tem-se como objetivo geral analisar o reconhecimento da precarização do trabalho em estabelecimentos de economia solidária, após a publicação da lei 12.690/2012 que regulamentou as cooperativas de trabalho no Brasil, a partir das decisões do TRT da 4º Região de 19 de julho de 2012 a 19 de julho de 2017. Com efeito, pretende-se responder ao seguinte problema: a partir das condenações/absolvições de estabelecimentos solidários em ações que discutem a precarização do trabalho, a economia solidária é um modelo capaz de superar a organização do trabalho atual e promover o empoderamento econômico/social de seus trabalhadores? A resposta inicial para o problema é negativa.
