The relationship between passive corruption and money laudering from the consumption principle’s perspective

Resumo: This study seeks to deepen the discussion on the apparent conflict of norms in economic criminal law, focusing on the relationship analysis between the crimes of passive corruption and money laundering from the principle of absorption perspective. Therefore, the article analyzes the fundamentals surrounding the apparent conflict of norms, the criteria for its solution, and the guidelines to identify the impunible posterior facts. Also, the values protected by the crimes of passive corruption and money laundering are examined, in order to ponder about the role of the legal interest in the examination of the principle of absorption. The study concludes that the complexity of acts of concealment/dissimulation that characterize money laundering is essential for the verification of its absorption by passive corruption offense.

Para tanto, serão analisados os fundamentos em torno do concurso aparente de normas, os critérios para sua solução e as balizas para identificação dos atos posteriores coapenados. Também serão examinados os valores tutelados pelos crimes de corrupção passiva e lavagem de capitais, para então ponderar sobre o papel do bem jurídico no exame da consunção.
