Resumo: | It is intended to identify, through this text, the doctrinal approaches that study the definition and the delimitation of effective judicial tutelage. Based on the identification of what would be an effective process, this study seeks to verify whether the interpretation of the principle of the judge's immediacy in relation to the evidence violates this constitutional principle. Therefore, the democratic process requires interpreters to constantly observe and study constitutional principles, as the use of vague and abstract terms does not allow a more adequate application of principles and the compatibility of procedural institutes with the Federal Constitution, hindering the evolution of civil procedural law in these new times. |

A partir da identificação do que seria um processo efetivo, o artigo busca verificar se a leitura que se faz do princípio da imediatidade do juiz em relação à prova viola esse princípio constitucional.
