Environmental protection and the principles of prevention and precaution

Resumo: This article deals with the legal and constitutional protection of the environment through the interpretation and application of the principles of prevention and precaution, which are consubstantiated as mechanisms for implementing human rights concerning jurisprudential understanding in Brazilian higher courts. As to the nature of the present research, it is characterized as theoretical. As regards the data processing, it is configured as qualitative. In addition, the research is as explanatory to investigate and, in relation to the conduct regarding the data collected, as bibliographical, through indirect documentation. Apply the deductive method in the data analysis, and conceptualize it as historical research. Our findings revealed that the Brazilian Superior Courts use the principles of precaution and prevention, concretizing the system of protection of the environment in the jurisprudential orbit.

Quanto à natureza da presente pesquisa, esta se caracteriza como teórica. No que se refere ao tratamento dos dados, configura-se como qualitativa. Ademais, a pesquisa situa-se como explicativa quanto aos fins da investigação e, em relação à conduta quanto aos dados angariados, como bibliográfica, mediante documentação indireta.
