Analysis of exceptional measures adopted by Portugal in the 2008 crisis: a guide of brazilian measures to overcome the fiscal crisis led by Covid-19

Resumo: Financial crises end up presenting States with serious economic crises, an opportunity in which adjustments to the Social Rights offered are necessary, under penalty of collapse in the current economic system. The suitability of the measures must be supported by the legality and constitutionality of the act according to the Constitutional Guarantees, so that it falls to the Constitutional Court to weigh and seal these acts, when validated before the Constitutional Principles structuring the Fundamental Guarantees. In the present study, the Guiding Principles and the validity of the restrictive measures imposed are analyzed, in order to compare with the possibility of future adoption by Brazil of similar practices.

A adequabilidade das medidas deve estar amparadas a legalidade e constitucionalidade do ato face às Garantias Constitucionais, de modo que recai ao Tribunal Constitucional a ponderação e chancela de tais atos, quando validados perante os Princípios Constitucionais estruturantes das Garantais Fundamentais.
