Política pública de atendimento à criança e ao adolescente nas perspectivas do CMDCA, CT e famílias

Resumo: | In Brazil, the promulgation of the 1988 Constitution and the entry into force of Children and Adolescent Statute, Law No. 8.069/90, popularly known as ECA, restructure the entire treatment legal, political and social which was given to children and youth so far. Thus, children and adolescent were considered to be subjects of rights, with priority, for being in a peculiar condition of biopsychosocial development. The proposal for a new policy health care aimed at children and teenagers in Brazil has proposed, among other things, decentralization of care and the creation of councils, in which case, created the Child and Adolescent Municipal Council and Guardianship Councils, these bodies committed to the process of decision making in relation to public policies aimed at satisfying the interests of the underaged. This study has finally research the public policies for children and youth in accordance with the Children and Adolescent Statute, with respect to the process of decision making and action Child and Adolescent Municipal Rights Council and the Guardian Council, in Viçosa - MG, and investigate the perception of households on the adequacy of these laws. Thus, it was adopted as the basis of this study a reflection on public policy given the concrete situation of children and adolescent health care, due to the Whole Doctrine Protection. To meet the objectives of this study was conducted documentary research, as well as semistructured interviews with the Child and Adolescent Municipal Rights Council, council members and a sub-sample of families who were assisted by CT-CRAS and sent to South. The results obtained from the Child and Adolescent Municipal Rights Council showed that respondents are aware of their roles, know the demands of families move toward important achievements in relation to the creation of public policies, but still have no power strategic, the limited institutional coordination for transform the various problem situations in diaries and political actions. The council members, though well aware of their responsibilities, they need more effective public policies to strengthen the work of the Guardian Council. And the families interviewed reported missing in the city programs that address their needs, such as strengthening the family ties and help in raising children. It is concluded that although progress has occurred since the creation of Councils and the inclusion of new actors in the process of political decision-making, Some adjustments in the process are still needed, especially in understanding the absolute priority to the deliberations of the Child and Adolescent Municipal Rights Council that have to be met by the Government, with also the representation, participation and social control policies, by families and civil society. Lack of resources can not be limited mediation between the interests of the child/ adolescent and the demands of families and the power games of the public policies managers. Care programs and actions to segment the youth should be aware that children and adolescent are beings inseparable from their family background and socio-Community components of singular importance in the governance structure and public policy agency for full protection of childhood and adolescent. |

Assim, crianças e adolescentes passaram a ser considerados sujeitos de direitos, com prioridade absoluta, por estarem numa condição peculiar de desenvolvimento biopsicossocial. A proposta de uma nova política de atendimento voltada à população infanto-juvenil brasileira propôs, dentre outras coisas, a municipalização do atendimento e a criação dos conselhos; sendo, nesse caso, criados os Conselhos Municipais de Direitos da Criança e do Adolescente (CMDCAs) e os Conselhos Tutelares (CTs), órgãos estes comprometidos com o processo de tomada de decisão em relação às políticas públicas voltadas à satisfação dos interesses infanto-juvenis. Este estudo teve por objetivo pesquisar as políticas públicas voltadas para o público infanto-juvenil, em conformidade com o ECA, no que concerne ao processo de tomada de decisão e atuação CMDCA e do Conselho Tutelar, no município de Viçosa MG, além de investigar a percepção das famílias sobre a adequação desses dispositivos legais. Com isso, adotou-se como fundamento deste estudo uma reflexão sobre políticas públicas considerando a situação concreta da política de atendimento à criança e ao adolescente, em face à Doutrina da Proteção Integral. Para atender aos objetivos deste trabalho, foi realizada uma pesquisa documental, além de entrevistas semiestruturadas junto aos conselheiros municipais dos direitos da criança e do adolescente, conselheiros tutelares e uma subamostra de famílias que foram atendidas pelo CT e encaminhadas ao CRAS-Sul. Os resultados obtidos junto ao CMDCA demonstraram que os entrevistados têm consciência dos seus papéis, conhecem as demandas das famílias, se movimentam na direção de conquistas importantes em relação à criação de políticas públicas, mas ainda não possuem poder estratégico, pela limitada articulação institucional, para transformar as diversas situaçõesproblema em agendas e ações políticas. As conselheiras tutelares, embora conheçam bem as suas atribuições, sentem necessidades de políticas públicas mais eficazes para o fortalecimento do trabalho do CT. As famílias entrevistadas relataram que faltam programas no município que contemplem suas necessidades, como o fortalecimento do vínculo familiar e ajuda na educação dos filhos. Conclui-se que, embora avanços tenham ocorrido, desde a criação dos Conselhos no município e a inclusão de novos atores no processo de tomada de decisão política, ainda há necessidade de haver alguns ajustes nesse processo, principalmente na compreensão da prioridade absoluta com que as deliberações do CMDCA têm que ser atendidas pelo Poder Público, como também na representação, participação e controle social das políticas por parte das famílias e da sociedade civil. A falta de recursos não pode ser limitada à mediação entre os interesses da criança/adolescente e as demandas das famílias, e os jogos de poder dos gestores das políticas públicas.
