The preservation areas width (APP) along the waters course stipulated by the Forest Code, as well as the various techniques that can affect them were the starting point of this research. The Forest Code, Law number 4.771, dated September 15, 1965, was created with the objective of the maintenance of the native forests in the rural properties, stablishing the limits of property. It defined areas that would be protected by Law (APP and RL) in which its forests and all native vegetation had to be mantained unmodified. The various modifications this Code was submited to, including the width of APP, showed the legislators difficulties in harmonizing the interests of the various actors involved. In spite of all the legal apparatus that guide the AAP, various studies have demonstrated that the legislation has faced difficulties in its application, mainly in regions with uneven topography. In this context the aim was to achieve (investigate) (examine) the specialists perception and opinion, regarding this legal precept – width and use – possibilities of legislation modifications, identify and hierarchize the variable techniques that can affect the width of APP along the waters course, and also the acceptance of a decentralized legal system of forest management. With this objective series of questions were made to specialist in the areas of politics, economy and forest management, ecology and rehabilitation of degraded areas, hydrology and soils. From the sample, a same point of view was obtained from the most of specialists regarding the disagreement concerning the width of the APP and the restricted use of them, suggestions to improve the Law and to arrange the hierarchy of the variables - such as relief/topography, land cover, soil, water, adjacent activities, width of the water course and climate - according to its importance, The greater number chose a decentralized forest management in the APP. It follows that, therefore, the specialists agreed with a decentralized legal system which took into account the local particularities and that the competence to define the width and use of the APP must be given to the technicians.
