Assisted human reproduction is today an alternative used by many men and women for having children. The emergence of in vitro fertilization techniques has allowed new possibilities in reproduction previously unavailable to humans. Among them, we can mention the possibility for a single woman to become pregnant without a sexual partner, reproduction for homosexual couples and heterologous reproduction.Although assisted human reproduction is socially accepted, there is no juridical law covering it. The research presented here aimed to investigate the legislators' actions on maternity, paternity and family, focusing on assisted human reproduction. The issues discussed here run through the comprehension of legislative and juridical discourse with a focus in the political field; we did this in order to better understand the gender implications presented in those discourses. Perceptions of senators and deputies regarding assisted human reproduction today are concentrated on projects that reaffirm the condition of mother-woman that is closest to nature. The Assisted reproduction technique should only fix ―defects, ―anomalies and ―diseases in women and men who are diagnosed as incapable to perform their socially required roles:that men and women should have children together. In this sense and according to this ―model‖, assisted human reproduction would not be recommended for all women or for all couples. Considering this ―model‖, assisted human reproduction would be recommended to heterosexual couple of reproductive age. In regard to paternity, the projects have protective measures in place to protect that are based on the naturalization of reproduction. In regard to families originating from reproductive technologies, there is the concern that the family should comprise mother, father and children and this therefore excludes homosexual couples and single mothers as beneficiaries.
