From Affirmative Legal Recognition to Compensatory Rationality in Environmental Licensing: Exploring the limits and possibilities of indigenous identity recognition

Resumo: The entrepreneurial activity of transportation infrastructure is framed within the perspective of sustainable development, in which the assessment of environmental impacts goes beyond biophysical effects. Aspects such as socioeconomic and cultural impacts are examined and weighed within a compensation framework, subjecting these projects to administrative environmental licensing. In Brazil, when such projects affect indigenous peoples, a specific item is established in the licensing process focused on studies and compensatory programs. The mitigating and compensatory measures require the consent of the indigenous community. Considering the theoretical and legal advancement in the principle of indigenous peoples' protection and their recognition as political organizations, the central proposition of this article is to investigate, through a case study, whether the agreements reached as compensation can facilitate indigenous political-cultural identity actions. The investigation is conducted from an exploratory perspective, using qualitative research methods, including bibliographic, documentary analysis and interview. The study is grounded in the examination of items agreed upon in the environmental licensing of the duplication of the BR 116 highway in the state of Rio Grande do Sul, which affected the Mbyá-Guarani indigenous people. The analysis reveals that this procedural space, established by normative force, was exploitable in terms of an identity-claiming discourse of indigenous citizenship, affirming sociocultural elements as part of their original identity as a people who have survived a diligent effort to suppress their identity and diversity.

Aspectos como los impactos socioeconómicos y culturales se determinan y ponderan dentro de una matriz de compensación, por lo que estas obras están sujetas a licenciamiento ambiental administrativo. Estas obras están sujetas a licencia administrativa ambiental. En Brasil, en caso de que dichas obras afecten a pueblos indígenas, se establece un ítem específico en la licencia destinada a estudios y un programa compensatorio. Las medidas de mitigación y compensación requieren el consentimiento de la comunidad indígena. Considerando la superación teórica y jurídica del principio de tutela de los pueblos indígenas y su reconocimiento como organización política, la proposición central de este artículo es verificar, a partir de un estudio de caso, si los acuerdos firmados como compensación pueden favorecer una acción político-cultural identitaria indígena. La investigación se realiza desde una perspectiva exploratoria, de carácter cualitativo, que adopta procedimientos técnicos bibliográficos, documentales y entrevistas, a partir del examen de los puntos acordados en la licencia ambiental de la duplicación de la carretera BR 116, en el estado de Rio Grande do Sul, que afectó al pueblo indígena Mbyá-Guaraní. El análisis encuentra que este espacio protocolario, establecido por la fuerza normativa, fue aprovechable respecto de un discurso reivindicativo de una ciudadanía indígena con énfasis reafirmante en elementos socioculturales, como pueblo originario, sobrevivientes de una diligente empresa de supresión identitaria y de diversidad.  A atividade empreendedora de infraestrutura de transportes, insere-se numa perspectiva de desenvolvimento sustentável, cujo conteúdo quanto aos impactos ambientais é averiguado para além dos efeitos biofísicos. Aspectos como os impactos socioeconômicos e culturais são apurados e sopesados dentro de uma matriz de compensação, de forma que essas obras ficam sujeitas a licenciamentos administrativos ambientais. No Brasil, na circunstância de tais obras afetarem povos indígenas se estabelece um item específico no licenciamento voltado aos estudos e programa compensatório. As medidas mitigadoras e compensatórias passam pelo consentimento da coletividade indígena. Considerando a superação teórica e jurídica do princípio da tutela dos povos indígenas e seu reconhecimento enquanto organização política, a proposição central deste artigo é verificar, a partir de um estudo de caso, se as pactuações firmadas como compensação podem favorecer uma ação política-cultural identitária indígena.
