The Complex Legal System for the Protection of Brazilian Protected Areas: A bibliographical review

Resumo: Brazil, with its abundant legislative diversity, usually exercised in environmental matters in the three spheres (Federal, State and Municipal) of the Legislative powers and, in part, by the Executive, end up creating a legal miscellany destined to the protection of areas of environmental interest. There are several ways and justifications for protecting areas, such as: APP, APA, Legal Reserve, Green Area, Parks, Biosphere Reserve, Geopark, among others. This article aims to clarify the apparent conflict and similarity between some legal guardianships that may fall on areas of environmental interest, seeking to distinguish the following: APA - Environmental Protection Area, APP - Permanent Preservation Area, RL - Legal Reserve, Green Area, Biosphere Reserve, Parks and Geopark, pointing out the specific legislation of each guardianship and the legal powers related to these guardianships. Through deductive research of bibliographic procedure, this work was carried out in the form of a literature review, pointing out, at the end, the needs for advancing the legislation.

Existen varias formas y justificaciones para proteger áreas, tales como: APP, APA, Reserva Legal, Área Verde, Parques, Reserva de la Biosfera, Geoparque, entre otros. Este artículo tiene como objetivo esclarecer el aparente conflicto y similitud entre algunas tutelas legales que pueden recaer en áreas de interés ambiental, buscando distinguir las siguientes: APA - Área de Protección Ambiental, APP - Área de Preservación Permanente, RL - Reserva Legal, Área Verde, Biosfera Reserva, Parques y Geoparque, señalando la legislación específica de cada tutela y las competencias legales relacionadas con estas tutelas. A través de una investigación deductiva de procedimiento bibliográfico, este trabajo se llevó a cabo en forma de revisión bibliográfica, señalando, en definitiva, las necesidades para el avance de la legislación.O Brasil com sua farta diversidade legislativa, usualmente exercida em matéria ambiental nas três esferas (Federal, Estadual e Municipal) dos poderes Legislativo e, em parte, pelo Executivo, acabam por criar uma miscelânea legal destinada à proteção de áreas de interesse ambiental. São várias as formas e justificativas para proteção de áreas, como por exemplo: APP, APA, Reserva Legal, Área Verde, Parques, Reserva da Biosfera, Geoparque, dentre outras. Este artigo tem por objetivo propõe a esclarecer o aparente conflito e similitude entre algumas tutelas legais que podem recair sobre áreas de interesse ambiental, buscando distinguir as seguintes: APA – Área de Proteção Ambiental, APP – Área de Preservação Permanente, RL - Reserva Legal, Área Verde, Reserva da Biosfera, Parques e Geoparque, apontando as legislações específicas de cada tutela e as competências legais relacionadas a essas tutelas.
