The participation of indigenous people throughout the process of drafting a Constitution for Chile (2022): a reinterpretation of the constituent people

Resumo: As part of a civilizational monologue, throughout its history, Chile has reproduced a formula of particular interest: although composed of several peoples, the nation-state has constituted itself without ever recognizing such actors as parts of its own identity. Between comings and goings, the perpetuation of such institutional posture has contributed to the recent participation of indigenous peoples in the outbreak of a constituent process settled with the purpose of overcoming deep social scars. In this context, this article aims to reflect upon the identity of the constituent actor responsible for drafting a project of Constitution for Chile based on the participation of indigenous peoples in the institution responsible for its writing and the consequences of such participation for a new perception of a Chilean political power accountable for conducting the process – the People(s).

Como parte de um monólogo civilizacional, o Chile reproduziu uma fórmula de particular interesse ao longo de toda sua história: embora composto por diversos povos, o Estado-nação constituiu-se sem jamais reconhecer tais sujeitos como partes de sua identidade. Entre idas e vindas, a perpetuação de tal postura institucional contribuiu para que, recentemente, os povos indígenas participassem da deflagração de um processo constituinte instituído com a finalidade de superar profundas cicatrizes sociais. Neste contexto, este artigo tem como objetivo refletir a respeito da identidade do sujeito constituinte responsável pela elaboração de uma proposta de Constituição para o Chile a partir da participação, dos povos indígenas, no órgão responsável por sua redação, e nas implicações de tal medida para uma nova conceptualização do poder político chileno responsável por levar a cabo tal processo – o(s) Povo(s).
