Resumo: This article aims to relate the themes of the original accumulation of capital and Law. For this, there will be a characterization of the original accumulation, rescuing Adam Smith’s indication, Marx’s suggestions until his formulation in chapter 24 of Capital and presenting the extension of this debate in the investigations into the transition from feudalism to capitalism. In the sequence, it will be tried to delimit the senses of Law in the discussion about original accumulation, including throwing a polemic on the more consolidated Marxist interpretation, in order to finally do a contrast with Marxist perspectives regarding the historical permanence of the original accumulation, thus reaching relevant consequences for the construction of a Marxist theory of Law on the periphery of capitalism.

Para tanto, haverá a caracterização da acumulação originária, resgatando a indicação de Adam Smith, as sugestões de Marx até sua formulação no capítulo 24 de O capital e apresentando a extensão deste debate nas investigações sobre a transição do feudalismo ao capitalismo.
