Resumo: This paper analyzes some of the approaches of Leopoldo Zea's thought in the matter of human rights and his humanist philosophy, highlighting his contributions around the concept of the universal that is modulated and understood in a situated way in each historical-cultural context of the Latin American region. For this, the different civilizing projects that, since the arrival of the Spaniards, have been tried to be applied to the political, legal and socio-economic reality in Latin America are exposed, such as the Iberian, Saxon, conservative, liberal, liberating and assuming projects. Likewise, in a creative way, it reflects on the "Calibanesque" use of Law, as an example of legal pluralism, using the figure of Caliban, one of the characters in the novel The Tempest by William Shakespeare, as a pretext.

Este trabajo analiza algunos de los planteamientos del pensamiento de Leopoldo Zea en materia de derechos humanos y su filosofía humanista, destacando sus aportes en torno al concepto de lo universal que se modula y se entiende de manera situada en cada contexto histórico-cultural de la región latinoamericana. Para ello se exponen los distintos proyectos civilizatorios que, desde la llegada de los españoles, se han intentado aplicar a la realidad política, jurídica y socio-económica en América Latina como son los proyectos ibero, sajón, conservador, liberal, liberador y asuntivo. Asimismo, de una manera creativa, se reflexiona sobre el uso “calibanesco” del Derecho, en tanto ejemplo de pluralismo jurídico, utilizando como pretexto, la figura de Calibán, uno de los personajes de la novela La tempestad de William Shakespeare. Este trabalho analisa algumas das abordagens do pensamento de Leopoldo Zea em matéria de direitos humanos e sua filosofia humanista, destacando suas contribuições entorno do conceito do universal que se modula e entende-se de maneira situada em cada contexto histórico-cultural da região latino-americana. Para isso, é apresentado os distintos projetos civilizatórios que, desde a chegada dos espanhóis, tem-se tentado aplicar à realidade política, jurídica e socioeconômica na América Latina como são os projetos ibéricos, saxões, conservador, liberal, libertador e assuntivo. Dessa forma, de uma maneira criativa, reflexiona-se sobre o uso “calibanesco” do Direito, como um exemplo do pluralismo jurídico, utilizando como pretexto a figura do Caliban, um dos personagens da novela A Tempestade de William Shakespeare.
