The Law Beyond the Mirror: contributions of people’s legal consultancy to social movement struggles toward the right to land and territory

Resumo: Indigenous peoples, traditional communities, and peasants organize themselves in social movements to struggle for their rights to land, territory, and health environment. Sometimes, they are defended by lawyers who practice people’s legal consultancy (a kind of legal advice and support). This study analyzes how these movements understandand struggle for their rights and may reflect on the possible contributions of people’s legal consultancy to achieve the full realization of these rights. It recovers some of the Brazilian social movements perspective through field research and is also based on theoretical research. The main conclusions indicate that the people’s legal consultancy contributes to access justice and to dispute for other legal paradigms which may be more favorable to the protection and enforcement of territorial rights.

Utilizou-se de pesquisa teórica e da sistematização e releitura de dados colhidos (em campo). O artigo parte de histórias, falas e canções de movimentos populares organizados em torno da luta pela terra e pelo território em meio rural no Ceará, que expressam suas compreensões sobre seus direitos e o papel da AJP na concretização destes, após o que se passa às reflexões críticas sobre as contribuições da AJP.
