Overcoming the logic of “understanding less and condemning more” by the hands and lenses of restorative justice

Resumo: This paper approuches the criminological thinking after the change from the welfare state to the post-modernand neoliberal period. In this context, feelings of in security and impunity, stimulated by the media, and the development of crime control solutions, through the hardening of penalties and the criminalization of conduct, are situated. These ideas are countered by the hyperincarceration and the criminological studies on the ineffectiveness of the prison. This sinalize that is necessary to develop other forms of punishment in order to overcome the crisis of the traditional penal system. Finally, we work on the Idea that Restorative Justice could be another form of censorship, critically assessing its potential and historical-temporal limitations.

Finally, we work on the Idea that Restorative Justice could be another form of censorship, critically assessing its potential and historical-temporal limitations.O artigo aborda o pensamento criminológico após a mudança do Estado de bem-estar social para o período pós-moderno e neoliberal. Neste contexto, situam-se os sentimentos de insegurança e impunidade, estimulados pela mídia, e o desenvolvimento de soluções de controle de criminalidade, por meio do endurecimento de penas e tipificação de condutas. Contrapõem-se essas ideias com o hiperencarceramento e os estudos criminológicos sobre a ineficácia da pena privativa de liberdade. Trabalha-se, pois, a necessidade de desenvolver outras formas de punição, a fim de superar a crise do sistema penal tradicional.
