THE LUGANO CONVENTION AND JURISDICTION OVER INDIVIDUAL CONTRACTS OF EMPLOYMENT

Resumo: Judgment of the Court of Justice of the European Union (First Chamber) of 11 April 2019, in Case C-603/17, Bosworth/ Hurley, offers a good opportunity to examine the provisions of Section 5 of Title II (Articles18 to 21) of the Lugano Convention of 2007, on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (known as the Lugano II Convention). articles 18 to 21 (Section 5), as well as their application in practice. Studies devoted to the jurisdictional questions which arise from international individual contracts of employment have, most of the times and up to the moment, centred their attention in the Brussels Convention and in the following Regulations Brussels I and I Recast ”“which form part of the so called “Brussels system”- as well as the noteworthy Case-law of the European Court of Justice which has interpreted them. However, due to its “parallel” character, it is also of interest to analyse those solutions which the Lugano II Convention provides and its application by courts. As a result, this decision shows a significant interest, taking into account the limited times that the European Court of Justice has faced the interpretation of the Convention, highlighting the need for a new revision of the Lugano II Convention which adapts those provisions to the changes which have been incorporated in the Regulation Brussels I Recast.

Los estudios dedicados a las cuestiones jurisdiccionales que suscitan los contratos individuales de trabajo internacionales han centrado su atención, en su mayor parte y hasta el momento, en las soluciones contenidas en el Convenio de Bruselas de 1968 y los Reglamentos Bruselas I y I bis que se han ido sucediendo -y que integran el conocido como “sistema de Bruselas”-, así como la notable jurisprudencia del Tribunal de Justicia de la Unión Europea que los ha interpretado. No obstante, debido precisamente a su carácter “paralelo”, igualmente resulta de interés analizar las soluciones que proporciona el Convenio de Lugano II y su aplicación jurisprudencial. Esta decisión, por lo tanto, posee un singular interés, debido a las escasas ocasiones en las que el Tribunal de Justicia se ha enfrentado a la interpretación del Convenio, poniendo de relieve la necesidad de una nueva revisión del Convenio de Lugano II que adapte tales preceptos a los cambios que han sido incorporados en el Reglamento Bruselas I bis.O acórdão do Tribunal de Justiça da União Europeia (Primeira Secção), de 11 de abril de 2019, no Processo C-603/17, Bosworth e Hurley, oferece uma boa oportunidade para examinar os preceitos da seção 5 do título II (artigos 18 a 21) da Convenção de Lugano de 2007, relativa à competência judiciária, ao reconhecimento e à execução de decisões judiciais em matéria civil e comercial (conhecida como Convenção de Lugano II), bem como sua aplicação prática. Os estudos dedicados a questões jurisdicionais decorrentes de contratos de trabalho individuais internacionais concentraram sua atenção, na maior parte e até o momento, nas soluções contidas na Convenção de Bruxelas de 1968 e nos Regulamentos de Bruxelas I e I bis que são eles estão acontecendo”“ e constituem o chamado “sistema de Bruxelas””“, bem como a notável jurisprudência do Tribunal de Justiça da União Europeia que os interpretou. No entanto, devido precisamente à sua natureza “paralela”, também é interessante analisar as soluções fornecidas pela Convenção de Lugano II e sua aplicação jurisprudencial.
