Beyond the judiciary: fake news judicial control in the information age

Resumo: This article seeks to expose an institutional incapacity of the Judiciary, which is a supposed power to control fake news in the Brazilian democracy. In order to do so, at first, we present the main reasons that stimulate and contribute to the resurgence of this social phenomenon, indicating, on the one hand, an architecture that facilitates the dissemination of fraudulent news (echo chambers and filter bubbles) and, for another, a user cognitively predisposed to share it (motivated reasoning account of fake news). In a second moment, when presenting the phenomenon as a legal fact, it is sought to present the main statutes that give rise to the repressive judicial action, that is not able to follow the hyper-speed of propagation of this fraudulent news. Finally, in exposing this institutional incapacity, it is argued that, while limited in its typical function, the Judiciary has little to contribute to the debate. Nevertheless, it is argued that the Judiciary can stimulate public and institutional debates for multisectoral solutions in the regulation and fight against this phenomenon, maintaining, therefore, the hygiene of fundamental democratic values ”‹”‹in a period of democratic recession.

Para isso, em um primeiro momento, busca-se apresentar as principais razões que estimulam e concorrem ao recrudescimento desse fenômeno social, indicando, por um lado, uma arquitetura que propicia a disseminação de notícias fraudulentas (echo chambers e filter bubbles) e, por outro, um usuário predisposto cognitivamente a compartilhá-la (motivated reasoning account of fake news). Em um segundo momento, ao apresentar o fenômeno enquanto um fato jurídico, busca-se apresentar as principais legislações que dão ensejo a atuação repressiva judicial, não sendo esta capaz de acompanhar a hipervelocidade de propagação dessas notícias fraudulentas. Ao fim, ao expor essa incapacidade institucional, defende-se que, enquanto limitado em sua função típica, o Poder Judiciário tem pouco a contribuir ao debate.
