This paper aims at examining the relationship between law and exception. With a legal-philosophical approach, it presents an analysis of the role of law during the state of exception balanced against the role of law in democratic times. In this way, this paper adresses (1) an empirical contextualization, which shows the misunderstandings around the exceptionality of the values protected by Transitional Justice; (2) the Law in times of exception; (3) the counter-exceptionality of Transitional Justice in post-authoritarian periods; (4) the perception of the Law as a measure for protecting values in the context of Transitional Justice; (5) an empirical recontextualization, in which the examples presented in the initial section are revisited by focusing on the understandings developed throughout the paper; and (6) the conclusions drawn, which identify, in the duty to protect democratic values, the fair measure of the application of the Law in carrying out Transitional Justice in post-authoritarian periods.
