REFLECTIONS ON LEGITIMACY, ACTIVISM AND SOCIO-POLITICAL AND LEGAL EMANCIPATION IN LATIN AMERICA

This article proposes a reflective reading of José Geraldo de Sousa Júnior's (2008) work, Law as Freedom: The Law Found on the Street Emancipatory Popular Experiences in the Creation of Law, discussing in particular the chapter entitled Social Conditions and Theoretical Possibilities for a Sociological Analysis -Legal. In this sense, we sought to understand and clarify the connections between Law and Sociology, which give rise to the so-called Legal Sociology, to finally discuss the theoretical, methodological and practical possibilities for a socially legitimate emancipatory legal epistemology, which arises in articulated public spaces through the link of the leading role of social movements, as subjects of collective and revolutionary rights. Notably in the context of the new Latin American democracy. To implement these purposes, a qualitative and analytical bibliographic review of the concepts present in the aforementioned thesis by Sousa Júnior (2008) was carried out, as well as in the notes of the Spanish Elías Díaz (1965) about Legal Sociology and, finally, the legal conceptions and repercussions on social movements based on Glória Gohn (2008), thus confirming the achievement of the theoretical and methodological objectives proposed by Direito Achado na Rua.
