ACCESS TO JUSTICE (SDG 16): THE ROLE OF THE HAGUE CONVENTIONS ON PRIVATE INTERNATIONAL LAW

Resumo: Sustainable Development Goal 16 of the UN Agenda 2030 includes an appeal to “provide access to justice for all”. This call is not limited to domestic access to justice. In our interconnected world, where people and companies must navigate an increasingly complex variety of legal systems, providing transnational access to justice is a growing challenge. This requires international cooperation including direct cross-border cooperation between courts and administrations, and a global legal infrastructure supporting such cooperation. The Hague Conventions on private international law contribute to this aim in several ways: by establishing transnational channels for administrative and judicial cooperation in civil and commercial matters generally and specifically to ensure the cross-border protection of children and vulnerable adults, and by ensuring the effectiveness of exclusive choice of court agreements concluded by commercial parties and by facilitating the effective recognition and enforcement of foreign judgments in civil and commercial matters.
