CAN THE SUPERPOWER EXERCISED BY THE SUPREME COURT BE CONSIDERED A TYRANNY OF THE JUDICIARY?

Resumo: The transition from the authoritarian to the democratic period in Brazil was consolidated with the advent of the 1988 constitutional charter, which has provided for the strengthening of constitutional justice mechanisms. Since then, the judicialization of politics has given rise to heated discussions on topics such as “judicial activism” and “limits to the exercise of the powers of constitutional jurisdiction. In reality, everything requires the intervention of the Supreme Court, which makes it a "superpower" and has been raising questions about the establishment of a tyranny of the judiciary, as well as adverse reactions from Parliament. It is in this scenario that we invoke two famous plays by Shakespeare (Julius Caesar and Measure by Measure) to analyze, in a more playful way, how the STF's activist stance and Parliament's inertia in legislative production can interfere with the realization of deliberative democracy.

Desde então, a judicialização da política tem ensejado discussões acaloradas sobre temas como “ativismo judicial” e “limites ao exercício das competências da jurisdição constitucional. Na realidade, tudo exige a intervenção do STF, o que o torna um “superpoder” e vem suscitando questionamentos quanto à instalação de uma tirania do Judiciário, bem assim reações adversas do Parlamento.
