Resumo: | The transition from the authoritarian to the democratic period in Brazil was consolidated with the advent of the 1988 constitutional charter, which has provided for the strengthening of constitutional justice mechanisms. Since then, the judicialization of politics has given rise to heated discussions on topics such as “judicial activism” and “limits to the exercise of the powers of constitutional jurisdiction. In reality, everything requires the intervention of the Supreme Court, which makes it a "superpower" and has been raising questions about the establishment of a tyranny of the judiciary, as well as adverse reactions from Parliament. It is in this scenario that we invoke two famous plays by Shakespeare (Julius Caesar and Measure by Measure) to analyze, in a more playful way, how the STF's activist stance and Parliament's inertia in legislative production can interfere with the realization of deliberative democracy. |

UnB - Law Journal of the University of Brasília; Vol. 4 No. 3 (2020): September - December; 183-202Direito.UnB - Revista de Derecho de la Universidad de Brasília; Vol. 4 Núm. 3 (2020): Septiembre - Dieciembre; 183-202Direito.UnB - Revue de Droit de l'Université de Brasília; Vol. 4 No. 3 (2020): Septembre - Décembre; 183-202Direito.UnB - Revista de Direito da Universidade de Brasília; v. 4 n. 3 (2020): Setembro - Dezembro | Edição Especial - Aviação Civil e Direito Espacial: aspectos regulatórios nacionais e internacionais ; 183-2022357-8009reponame:Direito.Unb (Online)instname:Universidade de Brasília (UnB)instacron:UNBporhttps://periodicos.unb.br/index.php/revistadedireitounb/article/view/26962/28475Copyright (c) 2020 Direito.UnB - Revista de Direito da Universidade de Brasíliahttps://creativecommons.org/licenses/by-nc-nd/4.0info:eu-repo/semantics/openAccessBotelho, Ana Cristina Melo de Pontes2023-11-09T02:19:20Zoai:ojs.pkp.sfu.ca:article/26962Revistahttps://periodicos.unb.br/index.php/revistadedireitounb/PUBhttps://periodicos.unb.br/index.php/revistadedireitounb/oairevistafdunb@gmail.com || periodicos.bce@unb.br2357-80092318-9908opendoar:2023-11-09T02:19:20Direito.Unb (Online) - Universidade de Brasília (UnB)false |
