This work aims to make, through historical ”“ sociological reflections, a reflection on the behavior of the judicial power in Brazil, in what concerns the fight of racial discrimination, taking as a parameter the duties of protection of human rights, especially specific human rights. Nevertheless, it is said that there are many signs the judicial power in Brazil has contributed to mitigate the concretization of specific human rights of black people and, because of so becoming an instrument of structured racism. The methodological development of the work is done as following: first there is the reflection of specific protection of the human rights under the perspective of racial discrimination in the international context, and from then, viewing the protective fallibility of legislative and judicial powers in the fight against racial discrimination in Brazil, highlighting that such fallibility and weakness in the dealing with racism are anchored in ideological aspects that are historically rooted.
