Public Management of Historical Heritage: an Analysis of the Legal Interrelationships between Identity and Memory in the Brazilian Context.

Resumo: The purpose of the text is to analyze the relationship between the Public Management of Historical Heritage in Brazil and Cultural Identity and to verify the pertinence and challenges of this relationship in the Brazilian heritage legislation and legal system. To this end, we work with the perspective of the existence of a felt, lived heritage and a heritage delimited by the public power, on which concepts in favor of cultural identity are associated, promoting a theoretical reflection of the interfaces established between memory, identity and heritage . We will seek to understand how these concepts are expressed in contemporary initiatives aimed at valuing cultural historical heritage.

Para ello, trabajamos con la perspectiva de la existencia de un patrimonio sentido, vivido y delimitado por el poder público, sobre los cuales se asocian conceptos a favor de la identidad cultural, promoviendo una reflexión teórica de las interfaces que se establecen entre memoria, identidad y patrimonio . Buscaremos comprender cómo estos conceptos se expresan en iniciativas contemporáneas dirigidas a la valorización del patrimonio histórico cultural.  O propósito do texto é analisar as relações entre a Gestão Pública do Patrimônio Histórico no Brasil e Identidade Cultural e verificar a pertinência e os desafios dessa relação na legislação e ordenamento jurídico patrimonial brasileiro. Para tanto, trabalha-se com a perspectiva da existência de um patrimônio sentido, vivido e um patrimônio delimitado pelo poder público, sobre o qual se associam conceitos em prol da identidade cultural, promovendo uma reflexão teórica das interfaces estabelecidas entre memória, identidade e patrimônio.
