Em meados da década 90, com o objetivo de adequar sua atuação em determinados setores, o Brasil adotou o modelo de agências reguladoras, entidades integrantes da Administração indireta, com autonomia financeira e administrativa, estabilidade de seus dirigentes e dotadas, entre outras, de função normativa. Analisar o panorama jurídicoinstitucional desta função normativa é o objetivo deste estudo, no que tange sua interação com os demais Poderes, em especial, o Legislativo. Para tanto, realiza-se um apanhado das características das agências reguladoras criadas no Brasil, expondo pesquisa quantitativa das normas editadas por elas. Em seguida, analisa-se as formas corriqueiras de utilização do poder normativo pelo Poder Executivo, pontuando-se uma a uma em face da Constituição Federal de 1988. Expõe-se o fundamento jurídico-constitucional da possibilidade de utilização do poder normativo às agências reguladoras, enfrentando duas controvérsias encontradas na doutrina, a saber: a suspeita de delegação inconstitucional de poder normativo pelo Poder Legislativo às agências reguladoras e a eventual ausência de legitimidade democrática destas para edição de normas. Estuda-se, ainda, o controle exercido sobre as agências reguladoras, com ênfase no controle Legislativo das normas emanadas por aquelas entidades, trazendo à luz o Decreto Legislativo nº 273/2014 promulgado para sustar a Resolução - RDC nº 52/2011 editada pela Agência Nacional de Vigilância Sanitária – Anvisa, narrando seus efeitos jurídico-políticos. In the mid-1990s, aiming to adapt its performance in some sectors, Brazil adopted the model of regulatory agencies, entities inserted in indirect Administration, with financial and administrative autonomy, stability of its managers and endowed, among others, with normative function. Analyzing the juridical-institutional panorama of this normative function is the objective of this study, in what concerns its interaction with the other Powers, especially the Legislative. For this, it was does a survey of the characteristics of the regulatory agencies created in Brazil, showing quantitatively of the norms edited by them. Next, the ordinary forms of utilization of normative power by the Executive Power are analyzed, one by one in the face of the Federal Constitution of 1988. It was exposed the legal-constitutional foundation of the possibility of using normative power to the regulatory agencies, facing two controversies found in the doctrine, such as: the suspicion of unconstitutional delegation of normative power by the Legislative Power to the regulatory agencies and the possible abcense of democratic legitimacy them to publish norms. It is also studied the control exercised over the regulatory agencies, with emphasis on the Legislative control of the norms issued by those entities, bringing to light the Legislative Decree nº 273/2014 promulgated to counter the Resolution - RDC nº 52/2011 edited by the Brazillian Health Regulatory Agency - ANVISA, narrating its legal-political effects.
