À luz da Teoria dos Jogos, a existência ou não de pontualidade em um determinado grupo social é consequência de um dos dois estados possíveis de equilíbrio de Nash no Dilema do Prisioneiro, dependendo se os indivíduos ou agentes sociais cooperam entre si, e são predominantemente pontuais, ou se optam pela deserção, e são predominantemente impontuais. O estado de equilíbrio no qual as recompensas são maiores para a sociedade como um todo é aquele no qual os indivíduos ou agentes sociais optam por cooperar entre si e são pontuais em suas relações. Indivíduos e agentes sociais podem ser incentivados a cooperar entre si. Uma forma de incentivo se dá pela atuação de um agente com autoridade sobre os demais, que tenha o poder de alterar as recompensas dos indivíduos ou agentes sociais que se relacionam, de modo a induzi-los à cooperação. No setor de transporte aéreo, nas relações entre o conjunto das empresas aéreas e seus usuários, esse papel é exercido pela agência que regula o setor, a ANAC. A impontualidade dos voos das empresas aéreas produz um impacto indesejado em seus custos operacionais, piorando seus resultados financeiros. A ação sancionadora da agência reguladora, através do mecanismo da multa, também pode afetar os indicadores financeiros de uma empresa de transporte aéreo. Comparando-se o impacto de ambos os fatores, procurou-se determinar a eficácia que tem a atuação da agência reguladora em sua capacidade de alterar as recompensas das empresas aéreas para a melhoria da qualidade dos serviços que oferecem. Punctuality is one of the most important attributes of value to users of this mode of transportation. According to the Game Theory, the existence or the lack of punctuality, as a behavioral characteristic of a social group, is a consequence of one of two possible states of Nash equilibrium in the Prisoner Dilemma. If individuals or social agents cooperate with each other and carry their assignments and appointments predominantly on time, punctuality can emerge as a behavioral characteristic of the group. On the other hand, if the first choice of those same individuals and social agents is to desert and be late or miss their appointments entirely, the lack of punctuality emerges as the norm for that social group. The state of equilibrium in which the rewards are greater to the group as a whole is the one where its members choose to cooperate with each other and are punctual. Punctuality can be fostered. One way to achieve it is by means of the interference of an agent with authority over the rest of the social group with the power to change the rewards of individuals and social agents depending on their will to cooperate or not with each other, to fulfill or not their obligations with each other on time. In the air transport industry, in Brazil, the role of fostering cooperation, thus punctuality, in the relations between air companies on one side and their users on the other, rests with the industry’s regulatory agency, ANAC. The tool at its disposal to fulfill this task is the fine it imposes on air companies whose flights are consistently delayed. Furthermore, the penalties imposed by the regulatory agency add to the undesired impact that delays have on the operational costs of air companies. Considering that the ultimate goal of the imposition of fines by the regulatory agency is the betterment of the air transportation, by comparing the burden of higher operating costs due to flight delays, on one side, to the fines the air companies have to pay the regulatory agency for those same delays, on the other, this paper sought to establish a measurement of the efficacy of the agency’s capability to change the rewards air companies earn from the service they provide as a tool to achieve the aforementioned goal.
