O STF consolidou o entendimento de que a prova encontrada de forma fortuita em interceptações telefônicas contra detentores de tal prerrogativa é válida, desde que não apresente ilegalidades. Por outro lado, sedimentou-se a orientação de que, para atrair a competência da Suprema Corte, deve haver indícios concretos do envolvimento da autoridade com prerrogativa nos delitos. Não obstante, em alguns julgados desta Corte, os Ministros entenderam que a persistência nas investigações pelo juízo de primeiro grau, após surgirem indícios concretos de envolvimento de parlamentar, transmuda o encontro fortuito de provas em investigação paralela. Para o STF, esse tipo de investigação usurpa sua competência e, consequentemente, enseja a nulidade das interceptações telefônicas que, desse modo não mais podem operar sobre a esfera penal do acusado. The Brazilian Supreme Court (STF) has consolidated the understanding that the evidence found incidentally in telephone interceptions against holders of such prerogative is valid, provided it does not present illegalities. On the other hand, it has also been suggested that, in order to attract the jurisdiction of the Supreme Court, there must be concrete evidence of the authority's involvement with prerogative in crimes. Nevertheless, in some judgments of this Court, the Ministers understood that the persistence in the investigations by the first degree court, after concrete indications of the involvement of parliamentarian appears, transmits the accidental meeting of evidence in parallel investigation. For the STF, this type of investigation usurps its competence and, consequently, it provokes the nullity of telephone interceptions that can no longer operate on the criminal sphere of the accused.
