A dignidade da pessoa humana como fundamento do Estado Democrático de direito, bem como os direitos e garantias fundamentais, não é compatível com o uso de algemas de forma arbitrária e não fundamentada. A redação da súmula exige a ocorrência de resistência por parte do preso ou de fundado receio de fuga ou perigo à integridade física própria ou alheia para que a autoridade possa utilizar algemas. Nas Reclamações Constitucionais ora analisadas, os reclamantes alegavam terem sido algemados fora das hipóteses previstas na súmula, devendo, assim, o respectivo ato processual em que ocorreu a violação ser anulado. No entanto, o Supremo Tribunal Federal julgou improcedentes 28 (vinte e oito) dos 29 (vinte e nove) pedidos pleiteados. The dignity of the human person as the foundation of democratic rule of law and fundamental rights and guarantees, is not compatible with the arbitrary and unfounded usage of handcuffs. The wording of the scoresheet requires the occurrence of the prisoner by resistance or well-founded fear of flight or danger to one's physical integrity or others so that the authority can use handcuffs. The Constitutional Complaints now analyzed, the complainants claimed were handcuffed outside the cases provided for in the score sheet and must therefore, its procedural act in which the violation occurred be annulled. However, the Supreme Court rejected 28 (twenty-eight) of 29 (twenty nine) pleaded applications.
