A repressão é uma das dimensões básicas da política de defesa da concorrência. O sistema brasileiro combina duas esferas punitivas: a penal e a administrativa. A atuação destas duas formas de intervenção repressivas apresenta problemas de funcionalidade e legitimidade. Por meio da análise documental e da comparação das normas, avalia-se a racionalidade deste sistema híbrido. Repression is one of the basic dimensions of antitrust policy. The Brazilian system combines two spheres punitive: the criminal and administrative. The presence of these two forms of repressive intervention presents problems of legitimacy and functionality. Through documentary analysis and comparison of standards, we assess the rationality of this hybrid system.
