Durante a redemocratização do Brasil, sob a hegemonia neoliberal, a atuação estatal no âmbito da cultura centrou-se nas leis de incentivo via isenção fiscal e, posteriormente, teve como lema a cultura como um bom negócio. Em contraposição a essa realidade, no início do século XXI, a diversidade e o fazer cultura foram colocados como centrais para pensar políticas culturais no país, culminando na criação, em 2004, da PNCV. No mesmo governo e com uma preocupação diferente, surge a ideia de criação do PCT, com a publicação de sua lei em 2012. Oito parâmetros, inspirados nos modelos de Mariscal Orozco (2007) e no estudo comparativo de Gomor dos Santos (2011), atuam como suporte para a presente apresentação e problematização das leis. As políticas também são tratadas da perspectiva dos sujeitos nelas envolvidos. Relações entre concepções que emergiram em campo, a saber: cultura popular e entretenimento, cidadania e consumo, localismos e globalização, são tratadas, com vistas a pensar o protagonismo social e a cultura na esfera estatal. Observar-se-á que, sendo a política de cultura um conjunto complexo de relações e um espaço de conflito e negociação, penetrado por diversos agentes e por outras políticas públicas, tanto na PNCV quanto no PCT convivem relações entre categorias consideradas antagônicas. Contudo, na Política Nacional de Cultura Viva, essas relações se configuram de modo expansivo, abrindo espaço para uma gama maior de manifestações culturais e apresentando um modo de funcionamento mais democrático do que no Programa de Cultura do Trabalhador. During the re-democratization of Brazil, under the neoliberal hegemony, the State action in the culture field was centered on incentive laws through the tax exemption and later chose the motto the culture as good business. In contrast to this reality, at the beginning of the 21st century, diversity and make culture were placed as concepts central to think about cultural policies in the country, culminating in the creation of the PNCV in 2004. In the same government and with a different concern, the idea of creating the PCT came about, with the publication of this law in 2012. Inspired by models Mariscal Orozco (2007) and the comparative study of Gomor dos Santos (2011), eight parameters act as basis for this presentation and problematization of laws. Policies are also treated in the perspective of those involved in them. Relationships between concepts that have emerged in the field research (popular culture and entertainment, citizenship and consumption, localism and globalization) are treated in order to think about the social protagonism and culture in the State sphere. Given that the culture policy is a complex set of relations and a space of conflict and negotiation, penetrated by several agents and other public policies, it will be observed that in the PNCV, as well as in the PCT, coexist relations between categories considered antagonistic. However, in the Política Nacional de Cultura Viva, these relationships are configured expansively, making room for a broader range of cultural manifestations and presenting a more democratic mode of operation than in the Programa de Cultura do Trabalhador.
