O estudo almeja também enriquecer a discussão acerca da temática sob a ótica da Ciência Política, argumentando que a permissão da repressão estatal aos menores em conflito com a Lei, tratando-os como maiores de idade, não tornará o Brasil uma nação mais segura ou pacífica. Com base em fundamentação teórica e em uma análise qualitativa - tendo por ferramentas investigativas a pesquisa bibliográfica, a análise documental e de conteúdo, por tratar de comparar argumentos diferentes – argumenta-se que o debate parlamentar e o pensamento da sociedade civil defensores da diminuição da idade de responsabilidade penal têm natureza diversionista, pois a problemática da delinquência juvenil não é, via de regra, consequência da inimputabilidade e nem produto da impunidade, mesmo porque já existe no País um sistema punitivo aos adolescentes infratores, mediante a aplicação coercitiva de medidas socioeducativas. Aduz-se que a delinquência tem causa multifatorial associada a disfunções do dever do Estado (políticas públicas focadas especialmente na educação), da família (convivência harmônica, equilibrada e protetora do menor) e da sociedade civil (oportunidades de aprendizagem para profissionalização e de ocupação produtiva, e de proteção contra toda sorte de exploração e de violência). Com efeito, os três núcleos essenciais – e responsáveis pelo desenvolvimento pleno do adolescente - não cumprem satisfatoriamente o comando constitucional determinado pela Assembleia Nacional Constituinte de 1987/88. The initial intent is to show the favorable and the contrary arguments of this debate and to place the issue in the context of the brazilian Criminal Law System and the Criminal Policy. The study aims also to enrich the discussion from a Political Science perspective, in order to argument that the permission of state repression on adolescents in conflict with the law, treating them as adults, won’t make Brazil a safer or peaceful nation. Based on a theoretical framework and qualitative analysis - having as investigative tools bibliographic research, content and documental analysis for treating and comparing different arguments - it is concluded that the parliamentary and civil society debate that defends the reduction of this legal age has diversionary focus, because the problem of juvenile delinquency isn’t the result or the product of either unimputability or impunity, because there is already a specific punitive system for teenagers in conflict with the Law in the country, enforced by the legal application of social and educational measures. The delinquency has many causes associated, like the State's dysfunctions (lack of public policies focused especially on education), family dysfunctions (deficiency of harmonious coexistence and lack of parental protectition) and civil society dysfunctions (abscence of opportunities for professional qualification and productive employment, and lack of protection against all kinds of exploitation and violence, as well). Indeed, the three areas don’t fulfill the specific constitutional command dictated by the National Constituent Assembly of 1987/88.
