Monografia (Bacharelado em Direito)—Universidade de Brasília, Brasília, 2015.http://bdm.unb.br/handle/10483/11661Monografia (graduação)—Universidade de Brasília, Faculdade de Direito, 2015.O presente estudo buscará perquirir a constitucionalidade dos atuais parâmetros de regulação das doações privadas, de pessoas físicas ou jurídicas, para atividade político-partidária, por meio da análise dos posicionamentos recentes do Supremo Tribunal Federal e do Congresso Nacional sobre a temática, à luz dos reflexos políticos e jurídicos do financiamento de campanhas sobre a qualidade da democracia brasileira e da representatividade. Objetiva-se evidenciar o relevo do tema para o resultado das instituições políticas e a sua repercussão sobre a justeza e a normalidade do processo eleitoral. Discutir-se-á os impactos decorrentes da influência do poder econômico sobre o êxito eleitoral, a evolução histórica da regulação legislativa dos gastos de campanhas e a análise juscomparativista do instituto jurídico do financiamento de campanhas em outras democracias consolidadas. Far-se-á, também, uma reflexão acerca da relação existente entre o financiamento empresarial e a corrupção sistêmica. Por fim, analisar-se-á os limites e possibilidades da decisão de declaração de inconstitucionalidade do financiamento empresarial, proferida nos autos da ADI nº 4650/DF. _____________________________________________________________________________ ABSTRACTThe present work intends to analyze the constitutionality of the current parameters of Brazilian regulation of private donations from citizens or corporations for political party activities , by analyzing the recent positions of the Supreme Court and the National Congress on the subject, based on the political and legal consequences of campaign financing related to the quality of Brazilian democracy and parliament representativeness. Intends to evidence the relevance of the theme to the political institutions and its impacts on the fairness and normalcy of the elections. Will discuss the influence of economic power over the electoral success; the historical evolution of the legislative regulation of campaign spending; and comparative law analysis of the legal institution of campaign finance in other democracies. Will also propose a reflection about the relationship between corporate campaign financing and systemic corruption.
