A partir da intensificação dos fenômenos globais e o fortalecimento das relações sociais inaugura-se uma configuração da sociedade marcada pela emergência de ordens jurídicas desenvolvidas à margem da atuação estatal. Essa transnacionalização do direito requer a estruturação de mecanismos capazes de legitimar e validar determinada ordem jurídica de acordo com a especificidade de cada sistema com o qual ela se conecta. O esporte é, hoje em dia, um sistema funcional social com pretensões claramente globais. Os organismos componentes do fenômeno esportivo são responsáveis por conferir maior harmonização global a uma ordem jurídica própria capaz de se estruturar de maneira autônoma. O Movimento Olímpico, as Federações Internacionais, a Agência Mundial Antidoping e o Tribunal Arbitral do Esporte são alguns dos principais elementos que serão tratados aqui com o objetivo de explicitar o funcionamento da Lex Sportiva. Também será dada a relevância devida ao papel fundamental desempenhado pelas relações de natureza contratual constituídas no bojo dessa estrutura organizacional. A Lex Sportiva, embora seja uma ordem transnacional autônoma, não está colocada em uma posição de isolamento diante de outras ordens jurídicas. As relações estabelecidas neste sentido demonstram a necessidade de se compreender o constante entrelaçamento existente em um cenário de pluralismo jurídico. _____________________________________________________________________________ ABSTRACTThe purpose of this paper is to identify the existence of Lex Sportiva as an autonomous transnational legal order. In an attempt to conceptualize the context of global legal pluralism, some aspects must be treated. There are important areas of law in which globalization may create a need for other models of regulation without the central role of national states. The legal phenomenon characterized as transnational law is directly connected with the emergence of some special legal orders. Thus, Lex Sportiva is a manifestation of transnational law related to the sports context and it demands an explanation about the particular mechanisms that guarantee the autonomy of this legal order. The Olympic Movement, the Court of Arbitration for Sport, the International Federations and the World Anti-Doping Agency are some organisms that contribute to the establishment of a particular legal order in reference to the sports context. From the analysis about the relations between these organisms, it is possible do set the framework for the harmonization and validation of Lex Sportiva. Observation of the contractual practices of private operators and the subsequent formation of a structure composed with a robust jurisprudence and regulation are indispensable in order to affirm the autonomy of this legal order. Nevertheless, this autonomy does not represent an absence of relations between different legal orders.
