Embora o ajuizamento de ações privadas antitruste já seja uma possibilidade aceita em jurisdições como a americana, a europeia e, inclusive, a brasileira, com diferentes graus de desenvolvimento, é certo que as ações privadas de danos causados por umbrella effects ainda constituem assunto relativamente novo, de modo que as jurisdições ainda estão aprendendo a lidar com essa demanda. Cuida-se de questão relevante tanto para aquele participa do cartel, que terá de arcar com os custos do pagamento desse tipo de dano, quanto para aquele que sofre o dano, que deve ter conhecimento acerca da possibilidade de pleitear esse direito. Na jurisdição brasileira, com efeito, não há discussão sobre umbrella effects, de modo que uma análise desse fenômeno sob o pano de fundo da responsabilidade civil brasileira se faz necessária. Although the private antitrust actions are already an accepted possibility in jurisdictions like the United States, the European Union and even in Brazil, with different degrees of development, it is undeniable that the private damages actions resulting from umbrella effects are still a relatively new subject, so that the jurisdictions are still learning about how to respond to that demand. That is a relevant matter both to those who participate on cartels, who have to bear the costs of the payment of that kind of damage, and to those who suffer the damages, who must have the knowledge about the possibility of presenting that demand. Indeed, in the Brazilian jurisdiction, there is no legal debate regarding umbrella effects and, for that reason, it is necessary to make an analysis of that phenomenon, under the parameters of the Brazilian civil liability system.
