Para tanto, será detalhado o desenvolvimento histórico do uso indevido de informação privilegiada e do fato relevante no ordenamento jurídico nacional, assim como as influências de ordenamentos jurídicos estrangeiros. A esta análise segue um exame minucioso do posicionamento emitido pela Comissão de Valores Mobiliários, órgão administrativo que regula o mercado de capitais, sobre a questão, tanto em aspectos conceituais como em nuances aplicáveis ao caso concreto. In order to do so, it will be detailed the historical development of the misuse of privileged information and the relevant fact in the national legal system, as well as the influences of foreign legal systems. This analysis follows a detailed examination of the position issued by the Comissão de Valores Mobiliários, the administrative body that regulates the capital market, on the issue, both in conceptual aspects and in nuances applicable to the specific case.
