Com o desenvolvimento da civilização Ocidental, o tema foi ganhando uma maior importância, diante da desigualdade social que cresceu exponencialmente com as Revoluções Liberais e a Revolução Industrial. Posteriormente, importantes conquistas foram sendo realizadas no campo social pelas classes proletárias, que se organizaram para lutar por melhores condições de trabalho e por representação política, que culminou no sufrágio universal. Assim, começou-se a verificar que a participação positiva do Estado era imprescindível para garantir os direitos do cidadão, inclusive o direito ao efetivo acesso à justiça. Nesse contexto, surge o Estado Social de Direito e, posteriormente, o Estado do Bem-Estar Social, quando o Estado passou a assumir a responsabilidade de assegurar, às expensas dos cofres públicos, o serviço de assistência judiciária aos mais necessitados. A Defensoria Pública se apresenta, nesse contexto, como instituição capaz de propiciar ao necessitado, individual ou coletivamente, a resolução de seus conflitos. Assim, este trabalho trata da evolução histórica do conceito de acesso à Justiça, dos obstáculos e medidas adotadas nos ordenamentos jurídicos ocidentais para superá-los. Aborda-se ainda o papel da Defensoria Pública na efetivação desse acesso e a evolução histórica da assistência judiciária no ordenamento jurídico brasileiro. Por fim, é apresentado um retrato sobre a realidade da Defensoria Pública no Brasil. Because of the development of western civilization, the topic has been gaining more importance in the face of social inequality that has grown exponentially with the Liberal Revolutions and the Industrial Revolution. Subsequently, important gains were being made in the social field by the needy group, who have organized themselves to fight for better labor conditions and political representation which culminated in universal vote. Thus, we began to see that the positive participation of the state was essential to ensure the rights of citizens, including the right to effective access to justice. In this context, there is the Social Rule of Law, and later the State of Social Welfare, when the state took over the responsibility to ensure, at the expense of the public purse, the service of legal aid to the needy. The Public Defender is presented in this context as an institution capable of providing to the needy, individually or collectively, the resolution of their conflicts .Therefore this work deals with the historical evolution of the concept of access to justice, obstacles and measures adopted in western legal systems to overcome them. Clarify the function of the Public Defender in the realization of this historic gateway and the evolution of legal aid in the Brazilian legal system. Finally, a picture of the reality of the Public Defender in Brazil is presented.
