Resumo: This article examines relationships among democracy, hegemony andthe law as a component of the superstructure, in face of an analysis of the philosophyof the praxis. Through a study of Gramsci’s texts, the author opposespublic and private, collective and individual, in the history of the incorporation ofRoman Law and elicits reflections on the theme of the modern State coincidingwith the liberal conception of law.
