Dissertação (Mestrado em Psicologia Clínica e Cultura)-Universidade de Brasília, Brasília, 2009.http://repositorio.unb.br/handle/10482/4628Dissertação (mestrado)—Universidade de Brasília, Instituto de Psicologia, Departamento de Psicologia Clínica, 2009.A presente pesquisa versa sobre as significações construídas do tempo transcorrido entre as decisões em ações que envolvem litígio em Varas de Família do Tribunal de Justiça do Distrito Federal e dos Territórios – TJDFT, na perspectiva dos vários participantes envolvidos na execução do processo judicial: família, advogado, juiz de direito, promotor público, e profissional psicossocial no contexto da Justiça. O objetivo geral foi identificar e analisar o significado do tempo para os participantes implicados nas decisões judiciais dos processos que tratam de divórcio destrutivo nas diversas instâncias vinculadas ao andamento da ação e que passam pelo Serviço de Atendimento a Famílias com Ação Cível – SERAF do TJDFT. Os objetivos específicos foram: averiguar como os participantes nas decisões judiciais significam o tempo em relação à durabilidade do processo e às questões subjetivas a eles vinculadas; verificar como o tempo cronológico é empregado durante a trajetória da ação processual em relação às expectativas desses participantes envolvidos na referida ação; e, analisar os benefícios e os impasses trazidos pelo tempo cronológico, vinculado aos prazos processuais, e pelo tempo subjetivo dos participantes implicados. Em sua fundamentação teórica, este trabalho buscou a epistemologia sistêmica como apoio, enfocando as dimensões do tempo cronológico e subjetivo e suas relações com a família em litígio e com a Justiça. Foram realizadas entrevistas semiestruturadas com os sujeitos da pesquisa a partir de um caso selecionado pela pesquisadora. O trabalho foi realizado no molde qualitativo, sob a perspectiva da pesquisa-ação, isto é, a investigação surgiu com a prática da pesquisadora. Os dados coletados permitiram estabelecer três zonas de sentido: tempo do andamento processual e dos prazos processuais; tempo subjetivo e tempo de decisão/resolução. Os resultados mostraram, dentre outras questões, não haver consenso para os participantes do processo decisório e nem entre eles, pois tanto a morosidade quanto a celeridade são consideradas benéficas e ruins. Evidenciaram também que o tempo subjetivo acaba se sobrepondo ao tempo cronológico, o que dá a sensação de duração maior do tempo do processo em Varas de Família. A última zona de sentido apontou haver divergência de entendimento entre decisão e resolução o que implica a relação tempo mensurável e tempo subjetivo no andamento processual. Assim, depreende-se que vai se construindo uma “malha” relacional a partir da existência do processo, que passa despercebido pelos participantes envolvidos permitindo que todos fiquem “contaminados” e “aprisionados” aos sentimentos que as famílias trazem no contexto da Justiça. Isso se explica pelo fato de a cultura em que vivemos enfatizar o sofrimento. _________________________________________________________________________________________ ABSTRACTThe present research examines the meanings constructed during the time lapse between decisions in litigious causes within the Federal District and Territories Family Court of Justice – TJDFT, from the perspective of the various participants involved in the execution of the judicial process: family, lawyer, judge, public attorney and the social-psychological professional in the Justice context. The general objective was to identify and to analyse the meaning of time for the participants implied in the Judicial decisions of the processes that deal with destructive divorce in the different instances connected with the development of the lawsuit and which are examined by the Service to Families with Civil Action – SERAF in TJDFT. The specific objectives were: to examine how participants in judicial decisions attribute meaning to time as related to the length of the process and to subjective issues connected with it; to verify how chronological time is employed during the trajectory of the lawsuit in relation with expectations of the involved participants towards the referred lawsuit; and analyze the benefits and issues that arise from the chronological time taken by process deadlinesand by the subjective time for the participants implied. In the theoretical basis, this research sought the sistemic epistemology for support, focusing on the dimensions of chronological and subjective time and their connections with the family involved in the lawsuit and the Justice. Semi-structured interviewed were conducted with the research subjects based on a case selected by the researcher. The worked was conducted in the qualitative format, under the action-research perspective, i.e., the research arose from the researcher’s praxis. The collected data allowed for three áreas of meaning to be established: processual time and processual deadlines; subjective time and resolution/decision time. The results show, among other issues, that there is no consensus for the participants in the decision-making process or between them, for slowness and swiftness are equally considered beneficial and harmful. It was also shown that the subjective time overrides chronological time, which brings the sensation of greater length in the lawsuits in the Family Court of Justice. The last meaning area indicated a divergence of understanding between decision and resolution, which implies a relation between measurable time and subjective time within the progress of the lawsuit. It is therefore understood that a relational ‘web’ is constructed from the existence of the process, which remains unnoticed by the participants involved, allowing them to be “contaminated” and “imprisoned” by the feelings which the families bring into the context of Justice.
