Permanent state of exception? a reading of Giorgio Agamben

Resumo: | The objective of this article is to answer the following question: has the State of exception become permanent? To this end, we rely on the theory on the state of exception by the Italian philosopher Giorgio Agamben and we begin the research work by presenting a brief historical evolution of the concept of state of exception. Next, we present the topology of the state of exception as a phenomenon that is located at the indeterminate level between democracy and absolutism and is used as a permanent government policy that legitimizes, without laws, using violence, not only physical repression, but also the political violence of governments in authoritarian attitudes against people to defend the legal order for the purpose of assuring sovereignty. Research on this subject contributes to the demystification of law and belief in the legal system as a foundation of fundamental principles, guarantor of justice and individual, collective and national security, by relating the State and its relation to the people within the political theory itself. Para tanto, nos apoiamos na teoria sobre o estado de exceção do filósofo italiano Giorgio Agamben e iniciamos o trabalho de investigação por apresentar uma breve evolução histórica do conceito de estado de exceção. Em seguida, apresentamos a topologia do Estado de Exceção como um fenômeno que está localizado no patamar indeterminado entre a democracia e o absolutismo e é utilizado como política de governo permanente que legitima, sem leis, utilizando da violência, não só repressão física, mas também a violência política, dos governos em atitudes autoritárias contra o povo para defender o ordenamento jurídico com fins de assegurar a soberania. A pesquisa sobre o tema contribui para a desmistificação do Direito e da crença no ordenamento jurídico como patamar de princípios fundamentais, garantidor da justiça e da segurança individual, coletiva e nacional, ao relacionar o Estado e a sua relação com o povo dentro da própria teoria política.
