Resumo: This text analyzes the social rights in the first Brazilian Republic in order to show how it influenced the other social processes. On one hand, it is a contribution to a better understanding of the judicial and political aspects of the transition process of the Brazilian social formation towards the capitalist way of production. On the other hand, it is a test for the general lines of a theoretical system which seems to be able to explain the evolution of the social rights not only during the republican period but also in the other social aspects that led to capitalism.
