Discretion in criminal justice: developing a framework for analysis

Resumo: | The introduction of the plea bargain in Brazilian’s legislation granted prosecutors a type of power generally called discretion. Failure to understand this change has caused difficulties in its analysis. In this article an effort is made to define discretion and review its use as a scientific concept in both the social sciences and legal studies with the goal of providing a better understanding of the subject to the scientific and public debate. Through the critical reading of published works in English as well as from Brazilian researchers that utilize its premises and methods, it is concluded that discretion as a concept has been used in variety of ways and that it is inadequate as an answer to questions that it has helped to ask. Finally, an alternative framework for social analysis is proposed in which discretion is decomposed before being requalified by social theory. |

La incomprensión respecto a esta modificación ha motivado dificultades en su análisis. En este artículo se hace una revisión acerca del modo en que la discrecionalidad fue abordada por las ciencias sociales y jurídicas con el objetivo de contribuir al desarrollo del debate social y científico en torno al tema. Por medio de la lectura crítica de la producción bibliográfica en lengua inglesa y de los trabajos brasileños que incorporaron sus premisas y métodos, se concluyó que esa categoría admitió gran variedad de significados y es inadecuada para responder a las cuestiones que ella misma ayudó a proponer. Finalmente, se sugirió un cuadro alternativo de análisis en que la discrecionalidad se descompone en sus partes para ser recalificada por la teoría sociológica.A introdução da colaboração premiada no Brasil atribuiu, sobretudo aos promotores e procuradores de justiça, um tipo de poder geralmente chamado de discricionário. A incompreensão a respeito dessa modificação tem motivado dificuldades em sua análise. Neste artigo é feita uma revisão a respeito do modo como a discricionariedade foi abordada pelas ciências sociais e jurídicas com o objetivo de contribuir para o desenvolvimento do debate social e científico em torno do tema. Por meio da leitura crítica da produção bibliográfica em língua inglesa e dos trabalhos brasileiros que incorporaram suas premissas e métodos, concluiu-se que essa categoria admitiu grande variedade de significados e é inadequada para responder às questões que ela mesmo ajudou a propor.
